The center would mean If the center of your choice is not available on Alextra Network, Alextra will help get that center on its network else help you with another center on its network. Alextra assumes no responsibility of any kind and by selecting the center you indemnify Alextra for any mishapening before, during & after the stay. Stay/s would mean activities, consultations, appointments, local procedures, travelling or anything even if it is not mentioned in this ToU/T&C.

Description of Services

The services provided by the Hospitality service Provider that require such Hospitality service Provider to have an up-to-date regulatory authorization, license, or certification are not verified, validated, or cross-checked by Alextra. Alextra is not responsible for any regulatory breach or malpractice by such Hospitality service provider.

Refund Policy

a. Refund Policy for Alextra Membership Plan Holders: Membership Plans are non-refundable.

b. All other refunds: All refunds that you may be entitled to shall be governed by this policy which forms a part of the Terms of Use of this website/services. By agreeing to the terms of use, you hereby agree to be bound by the terms of use and Privacy Policy of the website as well as the refund policy. Refund shall be given by Alextra in case the service provider under Alextra Alliance refuses to perform the even after you showing the code generated by Alextra to the center, An alternate center shall be suggested by Alextra. If the alternate suggested centers also do not allow the stay, Alextra will refund the money to you after its discussion with the hospitality service provider within 30 working days after deducting any applicable service charges. For claiming refunds, the customer should produce valid ID proofs and bank account details from which he/she has made the payments. For any further queries write in or call our customer care. Alextra shall endeavor to provide you all refunds you are entitled to within the time frame mentioned above. However, Alextra shall not be held liable to any delays/failure to provide the refund within the aforementioned time period due to any delays not attributable to Alextra. If Alextra makes a material modification to this ToU, it may notify you by displaying a prominent announcement above the text of this ToU or the Privacy Policy, as appropriate, for thirty (30) days, being deemed sufficient notification, of such changes. After notice of a modification to the ToU or the Privacy Policy has been posted for 30 days, the notice will be removed. If you have not used the Site for more than 30 days, you should check the ToU and/or Privacy Policy prior to any further use of the Site. Should you wish to terminate your account due to a modification to the TOS or the Privacy Policy, you may do so by sending an email with the subject line “Termination” to the email address. If you choose to continue using the Site, you agree that by doing so you will be deemed to accept the new ToU, Privacy Policy, Refund Policy and Disclaimer.

Trademarks

The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of Alextra and other parties. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of Alextra. All information and content including any software programs available on or through the Site (“Content”) is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

Survival of Terms After Agreement Ends

Notwithstanding any other provisions of this ToU, or any general legal principles to the contrary, any provision of this ToU that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this ToU.

General

If any of these conditions are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. This ToU and the relationship between you and Alextra will be governed by the laws of the India without regard to its conflict of law provisions. You and Alextra agree to submit to the personal jurisdiction of the courts located in New Delhi jurisdiction with respect to any legal proceedings that may arise in connection with this ToU. The failure of Alextra to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. Alextra does not guarantee it will take action against all breaches of this ToU. Except as otherwise expressly provided in this ToU, there shall be no third-party beneficiaries to this ToU. This ToU constitutes the entire agreement between you and Alextra and governs your use of the Site, superseding any prior agreements between you and Alextra with respect to the Site. Employees, partners and associated staff of Alextra are not accountable for any loss, harm or damage occurring due to usage of information from the portal. Customers are advised to use their own discretion in such matters. Alextra is not legally responsible for the same in any matter whatsoever. Alextra Membership Plan assists the customer with rates and get bookings only. It may also help in discounts wherever applicable. Alextra membership in no way is an Insurance Policy. The customer may add it on to his own travel Insurance Policy if he feels it’s appropriate. Please check with your Insurance Provider for the same. The facts & figures stated anywhere on the site are approximate and a personal view point of Alextra Team and holds no responsibility. User is advised to do their own research before using Alextra services. The rates may vary/change any time and Alextra holds no responsibility. Please do an in-depth survey of the market and purchase Alextra Membership Plan at your own risk. If you agree to purchase Alextra Membership Plan and become its member, it is understood that you have done it with your own free will & full consent and you indemnify Alextra fully. Alextra will try its best to pass on the discounts to the Alextra Membership Plan customers wherever possible but in no way is liable for the same. This depends on Alextra’s understanding with the various Hospitality Centers and may differ at different times and on a case to case basis. Hospitality centers displayed may not be tied up due to constant change in understanding with those centers. Members must write an email to know the exact status of any particular healthcare center at that time and discounts offered. Location of hospitality centers may not be accurate in the map. Please call up the hospitality center directly for exact location. Alextra will not be liable. Alextra will try its best to offer you the Hospitality Center of your choice else it will help you avail the services at an alternative empaneled Hospitality center. Alextra does not hold any responsibility for the quality of Hospitality Center. All Hospitality centers are working independently of Alextra and by no means Alextra looks after their management or their capabilities. The patient will be utilizing the services at his/her own risk. Alextra holds no responsibility for any commitments made by any agents. The customer is strictly advised to read Alextra Policies before purchasing Alextra Membership Plan. List of most Hospitality Centers is available on ‘Alextra.in’. The customer agrees to the fact that the list of centers is a dynamic process and the addition and deletion of the centers keep happening. Bookings and/or Discounts are available in most Hospitality Centers empaneled in Alextra network only. Booking appointment through Alextra website is a way to authorize and request Alextra to help in fixing the time slot as per the convenience of the customer, however final discretion is on the availability of hospitality centers and Alextra holds no responsibility whatsoever. The customer must Generate a booking code in advance BEFORE going to/contacting the Hospitality Center. Unless the booking code received on the cellular phone as sms is shown to the Hospitality Center, the Hospitality Center may not abide by their understanding with Alextra.
